If you partner/spouse or defacto lives overseas (outside Australia) and want’s to join you in Autralia this is the visa that you and your partner have to apply for.
It’s a two stage visa and you apply for both stages at the same time.
Now although these visa’s are usually granted separately (at separate times), depending on the conditions of your relationship it’s also possible that they are both granted at the same time.
Overview of Subclass 309 - First Stage
Stay: This is a temporary visa and you can stay until your permanent Partner visa (subclass 100) application is finalised or you withdraw your application.
You may be able to apply for a 309 Partner Visa if you meet the following requirements:

Sponsor’s Criteria & Obligations:
- You must sponsor your spouse or de facto partner and their family members included in their application. As a sponsor, you must assist your partner and their family members included in their application, financially and with their accommodation.
- Your sponsorship ends 2 years after your partner and anyone included in their application is granted this temporary Partner visa. This is the case even if they are granted their permanent Partner visa (subclass 100) immediately after they are granted the temporary Partner visa.

- You cannot withdraw as a sponsor for the Subclass 309 after the visa is granted, however, you can withdraw your sponsorship application any time before the permanent Partner visa (subclass 100) application is decided. The applicant may still be eligible for the permanent partner visa.

How do I convert my 309 visa to PR?
To convert your Subclass 309 visa to a permanent Subclass 100 visa, you can usually apply two years after you lodged your initial Subclass 309 visa application. However, if you have been in a long-term relationship or have children together, you may be eligible for the Subclass 100 visa sooner.
