Understanding partner visa refusal reasons matters.
A refusal is rarely just about not having enough photos.
Partner visas have legal criteria for the relationship, sponsorship, immigration history, health, character and accurate information.
These seven issues are a practical guide, not an official statistical ranking.
They are recurring problems Millennium Migration sees in preparation and refusal matters.
Their order does not show how often each causes refusal.

- Partner visa refusal reasons involve unmet legal criteria; a document gap may reveal a larger eligibility or evidence issue.
- A marriage certificate or relationship registration does not by itself prove a genuine and continuing relationship.
- De facto applicants need to understand the 12-month rule and its exceptions.
- Sponsor eligibility can affect the application even where the relationship is genuine.
- Applicants without a substantive visa may face Schedule 3 requirements for an onshore Partner visa.
- False or misleading information can create consequences far beyond the immediate application.
1. Partner visa refusal reasons: relationship evidence
This is one of the most important partner visa refusal reasons.
For spouses and de facto partners, Home Affairs considers the circumstances of the relationship.
The Regulations identify finances, household, social aspects and mutual commitment as relevant matters.
A weak application might contain many photographs but little evidence showing how the relationship actually functions.
Different addresses, unexplained finances or contradictory statements may raise questions.
Evidence should explain how the relationship developed.
Living apart is not automatically disqualifying; explain the circumstances.
2. The de facto 12-month requirement is misunderstood
One of the recurring partner visa refusal reasons is misunderstanding de facto eligibility.
A relationship of several months does not automatically meet the relevant duration rule.
Regulation 2.03A generally requires relevant de facto applicants to show 12 months in that relationship immediately before applying.
This is not simply a requirement for 12 months under one roof.
There are exceptions.
Importantly, the 12-month requirement does not apply where the relationship is a prescribed registered relationship.
Other limited exceptions can also apply.
Relationship registration, however, does not remove the separate requirement to establish that the relationship itself is genuine and continuing.
3. Partner visa refusal reasons: sponsorship
A Partner visa is not assessed only from the applicant’s side. The sponsorship must also satisfy the legislation.
Previous partner sponsorships and timing restrictions can affect sponsor approval, subject to exceptions.
Certain convictions can also create restrictions.
Not every conviction has the same effect; the applicable criminal-record rules and any discretion need checking.
This means a completely genuine couple can still encounter a serious sponsorship issue.
Check the sponsor’s previous visa and sponsorship history early.
Millennium Migration recommends doing this before paying the visa application charge.
- Relationship: genuine, continuing and supported by consistent evidence
- Applicant: eligibility, immigration history and applicable health/character criteria
- Sponsor: approval, prior sponsorships and relevant restrictions
4. Partner visa refusal reasons: Schedule 3
Schedule 3 is one of the more technical partner visa refusal reasons.
Certain subclass 820 applicants without a substantive visa must satisfy Schedule 3 criteria.
A compelling-reasons provision can allow particular criteria not to be applied.
It is not automatic.
This can affect people who lodge an onshore Partner visa after their substantive visa has expired.
A genuine marriage does not automatically remove Schedule 3. The relationship evidence and the Schedule 3 issue are separate legal questions.
Assess these cases carefully before lodgement.
The applicant’s immigration history and timing can significantly change the strategy.
5. False, misleading or inconsistent information
Trying to make an application look stronger by changing facts can create a much larger problem.
Home Affairs warns against bogus documents and false or misleading information.
Consequences can include refusal, cancellation, future application restrictions and legal action.
Even unintended inconsistencies can affect credibility.
Check first-meeting dates, past relationships, addresses, work, travel and the relationship timeline.
Forms, declarations and documents should agree, or explain genuine differences.
One of the most avoidable partner visa refusal reasons is attempting to hide an uncomfortable fact instead of explaining it properly.
6. Health or character requirements are not met
A genuine relationship does not override every other visa criterion.
Partner visa applicants must satisfy applicable health and character requirements.
Home Affairs can request medical examinations, police certificates and additional character information.
Criminal convictions do not automatically mean every Partner visa will be refused.
Serious character issues can lead to refusal under the Migration Act.
Applicants should disclose criminal history accurately. Failing to disclose it can create a second problem on top of the original offence.
7. The relationship ends before the permanent visa decision
Normally, the Partner visa pathway depends on the qualifying relationship continuing.
However, relationship breakdown does not automatically mean the application must fail.
An application may continue under specific provisions after separation or a sponsor’s death.
These can include family violence, death of the sponsor, or a child with qualifying custody, access or maintenance arrangements.
The tests depend on the subclass, stage and facts.
Having a child alone is not enough.
If the relationship ends, check the exceptions before deciding whether to withdraw.
Notify Home Affairs of relevant changes and get advice on the evidence needed.
Millennium Migration can review the application before a problem becomes a refusal issue.

Responding to partner visa refusal reasons starts with identifying the criteria for your application. Uploading everything you own is not the answer.
Then make sure the evidence tells one consistent story across your forms, statements and documents.
Check unusual circumstances early: a short relationship, time apart, previous sponsorships, overstays or refusals.
Criminal records, earlier marriages and conflicting information in old applications also need attention.
Those facts do not necessarily prevent a successful Partner visa.
But unexplained problems can become much harder to deal with after Home Affairs raises them.
FAQs about partner visa refusal reasons
Can a Partner visa be refused even if we are genuinely married?
Yes.
Marriage alone does not satisfy every visa criterion.
Home Affairs still considers the relationship requirements, sponsorship and other applicable visa criteria.
Is weak relationship evidence enough for a refusal?
If the Department is not satisfied that the required relationship criteria are met, the visa can be refused.
Does relationship registration guarantee approval?
No. Registration can be important for the de facto 12-month rule but does not by itself prove a genuine and continuing relationship.
Can an overstay affect an 820 application?
Yes. Applicants without a substantive visa can face Schedule 3 requirements, although compelling-reasons provisions may be relevant in some cases.
What happens if my Partner visa is refused?
Your refusal notice should explain any ART review rights and the application deadline.
Review rights vary.
Check the notice promptly; booking a consultation does not lodge a review.
